This User Terms and License Agreement ("Agreement") is a legal agreement between you ("User") and HatsuMuv Corporation ("HatsuMuv") regarding the use of the DynamixelForUnity plugin ("Plugin"). By using the Plugin, User agrees to be bound by the terms and conditions set forth in this Agreement.
1. Assumption of Risk
User acknowledges and understands that the operation of servo motors involves inherent risks, including the potential for physical harm or damage to property. HatsuMuv shall not be held responsible for any accidents, injuries, damages, or losses that may arise from the use of the Plugin. User assumes all responsibility for the safe and proper usage of the servo motors while utilizing the Plugin.
2. License Grant HatsuMuv grants
User a non-exclusive, non-transferable, and revocable license to use the Plugin for personal projects and research purposes only, subject to the terms and conditions of this Agreement. This license is granted on a per-user basis and is restricted to use on a single device.
3. Prohibited Actions
User agrees not to
Share or distribute the Plugin license to any other individuals or entities.
Use the Plugin on multiple devices or allow it to be used concurrently on different devices.
Modify, reverse engineer, decompile, or disassemble the Plugin or any part thereof.
Use the Plugin for any commercial purposes without obtaining a separate commercial license from HatsuMuv.
For personal licence user are prohibited with:
No Commercial Projects: User is strictly prohibited from using the Plugin in any project or application intended for commercial use without obtaining a separate commercial license from HatsuMuv. Commercial usage includes, but is not limited to, products for sale, services provided for compensation, or any project aimed at generating revenue.
No Monetization: User may not use the Plugin in any way that allows user or any third party to monetize, directly or indirectly, through advertisements, subscriptions, or other means.
No Derivative Commercial Products: User may not use the Plugin to create derivative works or applications that are intended for commercial distribution or any form of profit-making.
No Inclusion in Commercial Products: User may not integrate the Plugin or any portion of it into any commercial product without obtaining a separate commercial license from HatsuMuv.
Prohibited Commercial Activities: The Plugin cannot be used in any manner that results in commercial benefit, financial gain, or profit for user or any third party.
Non-Profit and Open Source Projects: The Plugin may be used in non-profit and open-source projects as long as the resulting project remains non-commercial.
4. Commercial Usage (Need to request permission)
For any commercial use of the Plugin, including but not limited to integration into commercial products, sale, or distribution, User must contact HatsuMuv to inquire about obtaining a commercial license. Commercial usage is strictly prohibited without prior written consent from HatsuMuv.
5. Intellectual Property
The Plugin and all related intellectual property rights are and shall remain the exclusive property of HatsuMuv. User agrees not to claim ownership of the Plugin or any derivative works thereof.
6. Warranty and Support
The Plugin is provided "as is," without any warranties or guarantees of any kind, whether express or implied. HatsuMuv does not warrant that the Plugin will be error-free or compatible with all systems. User agrees to use the Plugin at their own risk. Support for the Plugin may be available at HatsuMuv's discretion and subject to separate terms. Additionally, it is generally not allowed to transfer the license from one Device to another. If you wish to use the Plugin on a different Device, you will need to purchase an additional license.
7. Indemnification
User agrees to indemnify and hold HatsuMuv and its officers, directors, employees, and agents harmless from any claims, damages, liabilities, or expenses arising out of User's use of the Plugin or violation of this Agreement.
8. Limitation of Liability
In no event shall HatsuMuv be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the Plugin, even if HatsuMuv has been advised of the possibility of such damages.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of laws principles.
10. Jurisdiction
Any legal action or proceeding arising under or related to this Agreement shall be brought exclusively in the courts of Tokyo, Japan, and User hereby submits to the personal jurisdiction and venue of such courts.
11. Entire Agreement
This Agreement constitutes the entire understanding between User and HatsuMuv concerning the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether oral or written.
12. Modifications
HatsuMuv reserves the right to modify or update this Agreement at any time. Continued use of the Plugin after any such changes shall constitute User's consent to such modifications.
13. License Extension
HatsuMuv do not offer extensions for previously issued Plugin licenses. Users are required to purchase a new license for continued usage.
By using the DynamixelForUnity Plugin, User acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Agreement.
